1. Acceptance of Terms

By accessing and using PromptMaster AI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. DARUM GROUP LLC ("Company," "we," "us," or "our") reserves the right to modify these Terms at any time. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

2. Service Description

PromptMaster AI is a software-as-a-service (SaaS) platform that provides:

• Prompt Builder Tool — An AI-powered tool for creating, optimizing, and testing prompts for large language models
• Educational Courses — Online courses covering prompt engineering, AI fundamentals, and advanced techniques
• Community Features — Access to community resources, templates, and best practices
• Subscription Plans — Tiered access to features based on your subscription level

The Service is provided on an "as-is" basis. We make no warranties regarding the accuracy, reliability, or completeness of the Service or any content provided through it.

3. User Accounts and Registration

3.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account.

Subscriptions renew automatically on a monthly basis unless cancelled. You will be charged on the same day each month as your initial purchase.

4.3 Payment Methods

We accept major credit cards and other payment methods as indicated during checkout. All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your account for the subscription price and any applicable taxes.

4.4 Refund Policy

Subscription fees are non-refundable. However, if you cancel your subscription within 14 days of purchase, we will issue a full refund. Cancellations made after 14 days will not be refunded for the current billing period, but your subscription will not renew.

4.5 Price Changes

We reserve the right to change subscription prices with 30 days' notice. Price changes will take effect on your next billing date. If you do not agree to the new price, you may cancel your subscription.

5. Intellectual Property Rights

5.1 Company Content

All content provided by PromptMaster AI, including but not limited to text, graphics, logos, images, software, and course materials, is the property of DARUM GROUP LLC or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or transmit any content without our prior written permission.

5.2 User Content

You retain ownership of any content you create, upload, or submit through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content for the purpose of operating and improving the Service.

6. Acceptable Use Policy

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Specifically, you agree not to:

• Use the Service to create, distribute, or promote illegal content
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service to harass, threaten, defame, or abuse any person or entity
• Engage in any form of automated data collection or scraping without permission
• Reverse engineer, decompile, or attempt to derive the source code of the Service

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DARUM GROUP LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOST BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in Michigan, and you consent to the personal jurisdiction of such courts.
